ABSTRACT

Introduction: The legal issue in this paper is the uncertainty regarding the recognition of the COVID-19 vaccination policy as a citizen's right or obligation. Vaccination is a medical procedure that provides a vaccine that stimulates the production of immunity in the body as a preventive measure. The vaccination program is an effort to realize the 3 SDGs. In Indonesia, the rules regarding health rights and obligations are regulated in the Health Law, but it is still not explicitly regulated in terms of vaccination, nor is vaccine approval legally regulated. Furthermore, the Outbreak Management Act provides legal consequences for anyone who refuses to be vaccinated because it is considered to hinder the control of the epidemic. This paper analyses the categories of rights and obligations. Methods: This research applies normative legal research while the legal approach and conceptual approach are used as approaches. Results: The implementation of the COVID-19 vaccine policy as a human right has an inherent obligation to humans. Therefore, in practice the implementation of the COVID-19 vaccine policy as a citizen's right, in the end cannot be implemented, even though it is based on individual beliefs because there are obligations that require someone to fulfill the rights of others including the right to health and criminal sanctions are imposed if not implemented. onclusions: This research shows that the Covid-19 vaccination policy in Indonesia is not only a human right but also an obligation. So that criminal sanctions arise for people who do not implement them. © 2023 UPM Press. All rights reserved.

ABSTRACT

Introduction: This paper aims at conducting a legal analysis of the health workers' authority in telemedicine service in Indonesia. This article discusses an issue related to the importance of telemedicine usage in health services. That is beneficial to reduce virus transmission. Therefore, government issued regulations regarding telemedicine services by medical personnel. So, there is a change in the legal relationship that previously occurred in health care facilities into a legal relationship between doctors and patients. This case creates legal problems in the form of legal ambiguity regarding the authority of medical personnel through telemedicine services. Methods: Normative legal research implemented in this research and the approach implemented is the state and the conceptual approach. Results: Telemedicine provides medical services and health information. In Indonesia, telemedicine was made mandatory by Law Number 36 on Health in 2009, particularly in terms of medical expertise. Legal basis of telemedicine in Indonesia is the Law on health however the regulation is general. Conclusions: The conclusion is the need for detailed regulation of the limits of authority of health workers in health services through telemedicine. This article suggests that legal reform of the authority of medical personnel in providing services through telemedicine during the pandemic and after it. © 2023 UPM Press. All rights reserved.

ABSTRACT

This research aims to explore the implementation of the blended learning model and describe the teacher's perceptions of the constraints and positive impacts of applied learning. This research method uses a descriptive quantitative approach. A total of 41 respondents of mechanical engineering vocational teachers followed the filling of the instruments. Data were collected using a questionnaire in the form of respondent data, learning models used by vocational teachers and perceptions of vocational teachers. The findings of data explanatory research that are different from the implementation of the learning carried out are: (1) online theory learning without practice tends to use the Cooperative Learning of 14.63% and Problem Based Learning of 12.20%, (2) online theory learning with online practice, tends to use the Project Based Learning of 12.20%, (3) Online theory learning with offline practice, tends to use the Project Based Learning of 14.63%, and (4) learning with offline practice tends to choose inquiry learning and Project Based Learning of 2.44%. The main constraints that serve teachers are internet access and limited network availability, the positive impact on the general is the use of ICT. An important finding in this study is that vocational teachers must be able to organize learning evenly. © 2020 Institute of Physics Publishing. All rights reserved.
